An insurer should offer a defense to its insured, under a reservation of rights, if there is a question regarding coverage. It is best to initiate a declaratory judgment action in certain cases in order to resolve the coverage issue. In Massachusetts, if an insured prevails in a declaratory judgment action, it is entitled to collect attorneys’ fees and costs. In addition, if a reservation of rights letter is issued, an insured may make a claim for representation by counsel of its own choosing with compensation for fees paid by the insurer.
