BHPK’s Michael Stefanilo, Jr. analyzes a recent Tenth Circuit opinion which grapples with the constitutionality of a student’s antisemitic snapchat post stating that the student and some friends were about to “exterminate the Jews.” The court held that the remark did not cause a substantial disruption to the school and, therefore, was constitutionally protected.
