Massachusetts Whistleblower Defense For Employers
The Massachusetts Whistleblower Statute, M.G.L. c. 149 section 185, has resulted in an increasing number of lawsuits against public employers. The law only applies to public employers and protects employees who disclose, or threaten to disclose, provide information or testify, or object or refuse to participate in a violation of the law, rule or risk to public health, safety, or environment. This statute also provides enhanced penalties against employers who violate it, such as multiple damages and attorneys’ fees.
The statute itself is relatively new and there is not a great deal of case law interpreting this law.
