Practice Areas
Ms. Fitzgerald’s practice focuses on personal injury defense, municipal liability and employment law.
In her municipal liability practice, in which she has represented dozens of municipalities, Ms. Fitzgerald recently obtained pre-trial dismissals on behalf of municipalities in a number of cases in which plaintiffs sustained injuries in public recreational areas. Ms. Fitzgerald successfully argued that the plaintiffs were not entitled to relief because of the terms of the Recreational Use Statute. She also successfully defended a town against a lawsuit filed by a plaintiff who claimed the town was negligent for failing to properly supervise the activity at a public ice rink, resulting in injury to the plaintiff. Following a trial in Essex Superior Court, the jury found in favor of the town.

Prior to joining Brody, Hardoon, Perkins and Kesten, Ms. Fitzgerald was in private practice. She has also worked as a staff attorney for the Department of Revenue, and served as Chief Trial Court Law Clerk for the Vermont trial courts following her graduation from law school.
