Boston Insurance Coverage Lawyer

MA Insurance Coverage Attorney

BHPK also assists claimants, policyholders, and insurers with insurance policy analysis. We have been retained to evaluate a broad spectrum of coverage issues dealing with a wide range of policy types including:

Complex coverage issues often arise when insureds make claims for defense and indemnification for construction claims, business interruption and property loss claims, claims for bad faith and punitive damages, errors and omissions claims, and malpractice claims. We provide coverage opinions, guidance, and monitoring of claims.

We provide advice to our clients on state specific case law. For example, the duty to defend in Massachusetts is much broader than the duty to indemnify. An insurer should offer a defense to its insured, under a reservation of rights, if there is a question regarding coverage. It is best to initiate a declaratory judgment action in certain cases in order to resolve the coverage issue. In Massachusetts, if an insured prevails in a declaratory judgment action, it is entitled to collect attorneys' fees and costs. In addition, if a reservation of rights letter is issued, an insured may make a claim for representation by counsel of its own choosing with compensation for fees paid by the insurer.

Our attorneys are experienced in declaratory relief litigation and pride themselves on consistently obtaining results that are beneficial to our clients.
