Massachusetts Pre-Litigation Services
BHPK offers pre-litigation services to our municipal and private clients, including counseling them about particular controversies that arise in the workplace. This counseling can occur as soon as an internal complaint of discrimination or sexual harassment is made to a human resource department or other supervisor by an employee. In other situations, we can provide advice prior to significant discipline or termination of an employee. Our main goal is to ensure compliance with employment laws and to prevent or minimize the effects of litigation.
BHPK partner Leonard Kesten often works with human resource departments to draft and review their employment handbooks and policies, including their sexual harassment and anti-discrimination policies. He has also assisted employers with issues that arise during employee performance reviews, discipline, and termination procedures. If needed, he can partner with businesses to create and implement training for employees on the policies developed.
If a complaint of discrimination or sexual harassment does arise, BHPK attorneys will perform internal investigations when complaints of discrimination or harassment are raised. We counsel clients on particular issues that arise during the employment relationship, including compliance with the Family and Medical Leave Act, reasonable accommodation requests, employee performance reviews, and discipline, among others.
